The High Court today handed down its decision on an application for special leave to appeal lodged by Jenny Hocking.
Hocking sought to appeal the decision of the full court of the Federal Court that letters exchanged between Governor-General Sir John Kerr and the Monarch were personal and private correspondence. Kerr's personal records will therefore remain subject to the conditions set out in the Instrument of Deposit (that is, they will remain closed until 8 December 2027).
The appeal was upheld.
The National Archives is now considering its next steps in this matter.
